Gathright Sr. wrote his will on 19 May 1770.
He died sometime prior to 2 February 1774, when Samuel Sr.’s daughter
Agnes signed a marriage contract with William Garthright. Due to the British destruction of records
during the Revolutionary War, it is unknown when Samuel Sr.’s will was
originally recorded. However, the will
was re-recorded on 14 April 1783, when citizens gave testimony before the
county commissioners regarding records that had been destroyed.
In the name of God Amen, I Samuel Gathright of the County of Henrico being in perfect health and good memory do make and ordain this to be my last will and testament as followeth
Imprimis, I give and devise unto my son Samuel Gathright the plantation whereon he now liveth and all the land of the south side of the deep run concluded six hundred acres of land more or less and one hundred acres more or less joining James Lindsay’s line to a line that I made myself running along to his own line unto my said son Samuel and to his heirs and assigns forever. Also I give unto him four negro slaves named Dick, Sarah, Milly and Diver together with their increase unto him and his heirs and assigns forever.
Item, I give and bequeath unto my son John Gathright the plantation whereon he now liveth lying on the south side of the White Oak Swamp beginning upon the Swamp running along my old line to a new line that I made myself running along the new line to my son Samuel’s line and thence to the White Oak Swamp concluding six hundred acres more or less, and I also rive unto him four negro slaves named Jack, Pat, Peter and Effe together with their increase unto him and his heirs and assigns forever.
Item, I give and bequeath unto my loving wife Agness Gathright during her natural life or widowhood four negro slaves named Pompey, York, Jude and Luce, and after her decease I give them unto my three daughters and my son William.
Item, I give and bequeath unto my daughter Ann the negro girl named Luce and her increase unto her and her heirs + assigns forever.
Item, I give and bequeath unto my daughter Agness the negro named Pompey unto her and her heirs and assigns forever.
Item, I give and bequeath unto my daughter Tabitha the negro girl named Jude and her increase unto her and her heirs and assigns forever.
Item, I give and bequeath unto my son William Gathright the negro man named York unto him and his heirs + assigns forever.
These four negroes that I have left to my wife I leave them to my four children above mentioned.
Item, I give and bequeath unto my loving wife Agness Gathright two feather beds and furniture to only one that I now lye on and all the rest of the household goods besides what is mentioned unto her as long as she liveth and after her decease to be equally divided unto my two daughters and my son William, Anne and Agness unto them and their heirs and assigns forever.
Item, I give and bequeath unto my son William Gathright the plantation whereon I now live lying on the south side of the White Oak Swamp and all the land lying on the north side of the South Branch to a new line that I made myself between I and my son John concluding six hundred acres of land more or less and all the land that I purchased of the Martins on the western run containing sixty acres more or less unto him my said son William + his heirs and assigns forever.
Item, I also give unto my said son William six negro slaves named Siller, Bea, Lydia, Jeffrey, Nat and Hannah together with their increase and I also give unto my son William one feather bed and furniture as it stands in my house and two guns unto him and his heirs and assigns forever.
Item, I give and bequeath unto my daughters Anne and Agness all my lands on the south side of Chickahominy Swamp containing one hundred and thirty eight acres of land to be equally divided between them, also I give unto them sixty pounds to be divided between them and their heirs + assigns forever.
Item, I give and bequeath unto my daughter Anne Gathright four negro slaves named Will, Sue, Gabe and York the son of York together with their increase unto her and her heirs and assigns forever.
Item, I give and bequeath unto my daughter Agness Gathright four negro slaves named Beck, Stephen, Mark + Turner together with their increase unto her and her heirs and assigns forever.
Item, I also give and bequeath unto each of them Anne and Agness one feather bed and furniture as they stand in my house to them + their heirs + assigns forever.
Item, I give and bequeath unto my daughter Tabitha Gathright four negro slaves named Jenny, Phillis, Doctor + Sam, together with their increase unto her and her heirs and assigns forever.
Item, I give and bequeath unto my loving wife Agness Gathright one negro slave named James unto her as longs as she liveth, and after her decease she may give him to whom she pleaseth.
Item, I give and bequeath unto my daughter Tabitha sixty pounds in lieu of land, and a horse and one feather bed and furniture, one chest, four chairs and four plates one dish and one bason, seven head of cattle eight sheep unto her + her heirs and assigns forever.
Item, I give and devise unto my wife and my two daughters and my son William all my stock besides what is mentioned to be equally divided amongst them, horses, cattle, hogs, sheep, and after my wife’s decease she may give her part to whom she pleases, and if either of them die with[out] issue all that I leave them is to be equally divided amongst them that are living unto them and their heirs and assigns forever.
Item, I give and bequeath unto my two daughters Anne + Agness the use of my house as long as lives single + no longer.
Item, I give and bequeath to my sons Samuel, John and William my two whip saws, two cross cut saws and my coopers and carpenters tools to be equally divided amongst them and their heirs and assigns forever.
Item, I give and bequeath unto my son William Gathright all the plantation working tools to him and his heirs and assigns forever. And I desire that my estate may not be inventoried or appraised.
Item, I leave my three sons Samuel, John and William Gathright my whole and sole executors of this my last will and testament. In witness whereof I have hereunto set my hand and seal this nineteenth day of May one thousand seven hundred and seventy.

appeared on the 1783 tax list, along with four of his sons, John, William,
Benjamin, and Joseph. The tally
indicates that three of the men were over the age of 21, while two were aged
between 16-21. Samuel owned 28 slaves
(14 of whom were tithable), 10 horses, and 53 cattle.

deeds all made on the same day, Samuel Garthright gave land to three of his
sons: 100 acres of his own plantation to
his son Benjamin; 265 acres purchased
from James Cock & Richard Randolph to his son John; and 266 acres purchased by Samuel’s father
from James Cock to his son Joseph.

1791, when the will was proved in court.
In the name of God amen, I Samuel Gathright of Henrico County being in perfect senses and of sound memory as constitute, ordain and appoint this as my last will and testament in manner and form as followeth:
Imprimis, I give and bequeath unto my son John Gathright four slaves named Dick, Simon, Biddy and Hannah, to him and his heirs forever
Item, I give and bequeath unto my son William Gathright two hundred and sixty five acres of land be the same more or less heretofore marked out by self. Also four slaves named Charles, Joe, Claiborn and Nan to him and his heirs forever
Item, I give and bequeath unto my son Benjamin Gathright two hundred acres of land including the manor plantation. Also six slaves names Will, Anthony, Dilea, Nat, Moll and Dorcas, one bed and furniture one horse, four head of cattle, all which I give unto my said son to him and his heirs forever, provided he gives the free privilege of his sister Agness Gathright living with him during her life or single state. I also give unto Benjamin Gathright my family Bible unto him and his heirs forever
Item, I give and bequeath unto my son Thomas Gathright three hundred acres of land being part of the land I now live on, the bounds to be ascertained by line beginning on deep run, and running between my dwelling house and the kitchen, and so on till the quantity is obtained. Also four slaves named Jacob, Martin, Amey – Fannah, one bed and furniture, one horse, four head of cattle, to him and his heirs forever
Item, I give and bequeath unto my son Joseph Gathright, four slaves named Jummy, Arthur, Sylvey, and Mourning. Also one bed and furniture to him and his heirs forever
Item, I do hereby and my will is such, lend unto my daughter Frances Carter four slaves during her natural life, named Sarah, Wynney, Lydia and Paul, and the slaves so lent to be equally divided between the children of my said daughter Frances at her death to them and their heirs forever. Also five shillings to her and her heirs forever
Item, I do hereby and my will is such, lend unto my daughter Elizabeth Parker five negros during her natural life, named Betty, Wynney, Tarlton, Sall and Hannah, and the slaves so lent to be equally divided between the children of my said daughter Elizabeth at her death to them and their heirs. Also five shillings to her and her heirs forever
Item, I give and bequeath unto my daughter Agness Gathright seven slaves named Nelly, Jean, Lucy, John Elisha, Phebe and Mary, one bed and furniture, one horse and four head of cattle, to her and her heirs forever.
Item, I give and bequeath unto my daughter Mary Goode six slaves named Milly, Stephen, Phil, Moses, Dicey and Suky, one bed and furniture, one horse, four head of cattle, to her and her heirs forever
I also give and bequeath unto my son Benjamin Gathright, Agness Gathright and Thomas Gathright the crop that’s now on the plantation after the negroes being clothed to them and their heirs forever.
And it is my will and desire that the remaining part of my estate of every kind whatsoever after my just debts are paid should be equally divided between my children herein mentioned to them and their heirs forever
And lastly I do hereby appoint my three sons, John, William and Benjamin Gathright executors to this my last will and testament. Witness my hand and seal this 11th day of August 1791
